We can advise you and provide a line-by-line report on your infomercial to tell you about its compliance to the Television Advertising Code, and what amendments you need to make so that it can be cleared for broadcast. We can then edit and repackage your infomercial, obtain Clearcast approval, and deliver the tape for transmission.
As well as getting your infomercial approved, our aim is to help you maintain its selling power in the UK market.
who does what in compliance?
Ofcom
UK commercial TV channels operate under licence from the Office of Communications, which requires compliance with the BCAP Television Advertising Code. Ofcom has powers to fine a broadcaster and revoke their licence.
Broadcasting Committee of Advertising Practice
The BCAP Code prescribes the type of products and services than can be advertised, and amongst other things, applies strict rules about claims and offers.
Advertising Standards Authority
Ofcom has delegated day-to-day regulation of radio and television commercials to the ASA, who deal with complaints and publish a weekly bulletin of their adjudications.
Clearcast
Clearcast is a private organisation that pre-clears commercials for UK broadcasters. Most stations require a Clearcast Notice of Approval before they will transmit a commercial. In 2008 Clearcast changed its name from the Broadcast Advertising Clearance Centre (BACC).
